Résumé

Following significant reforms over the last 20 years, merger control regimes in Latin America now constitute around 20% of merger regimes worldwide. In regard to global transactions that may trigger the notification thresholds in many of these jurisdictions, it became necessary that an up-to-date book analyzing current legislation and case law be available for practitioners. This book compiles for the first time the applicable law governing merger control in Latin America. More than 30 distinguished authors, from both private and enforcement backgrounds, cover 17 jurisdictions and the Caribbean Community (CARICOM). For each jurisdiction, the reader will find: a presentation of the merger control system; a description of the applicable procedures and; an analysis of the most relevant case law on the subject.In addition, the editors, Paulo Burnier da Silveira and Pamela Sittenfeld, provide an overview of the merger regimes in Latin America, as well as a synthesis of the particularities of the regimes addressed in the book.

L'Auteur

  • Paulo Burnier da Silveira is currently a Senior Competition Expert at the OECD. Amongst his activities, he serves as OECD’s contact person for the OECD Regional Centre for Competition (RCC) in Latin America, which provides capacity building assistance and policy advice for competition officials from the region. The RCC is based in Lima, Peru. Further information: oe.cd/lima-rcc. He is also a Law Professor at the University of Brasilia (on leave) and a former Commissioner at the Brazilian Competition Authority (CADE). He has several publications in the field of competition law and policy, including “Global Competition Enforcement: New Players, New Challenges” (Kluwer, 2019), “Competition Law and Policy in Latin America” (Kluwer, 2017) and “Le Contrôle des Concentrations Transnationales” (Harmattan, 2013). He was also the lead editor of CADE’s Competition Journal from 2013 to 2019.
  • Pamela Sittenfeld (Edité par)

    Pamela Sittenfeld is Chief Of Staff and Advisor to the Minister of Foreign Trade of Costa Rica. She was a special counsel for BLP Legal. She was counsel and executive director of the Commission for the Promotion of Competition for nine years. She has been a member of the National Supervisory Council of the Financial System and a Board Director of the Public Services Regulation Authority. In addition, she has worked as a consultant for competition authorities in Costa Rica and other countries, as well as for international organizations such as the World Bank, the United Nations Conference on Trade and Development (UNCTAD), the Inter-American Development Bank, and the United Nations Commission for Latin America and the Caribbean. Pamela obtained her Law degree from Universidad de Costa Rica in 1996. In 1999, she earned a master’s degree, with distinction as a Chevening Scholar, in Regulation, Competition and Public Service Regulation from the London School of Economics and Political Science.
